Please read these Terms carefully before using Beema Dokaan. They govern your use of our platform and services.
1. Acceptance of Terms
By accessing or using the Beema Dokaan platform (the "Platform"), including our website at beemadokaan.com.np and any associated mobile application, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform.
These Terms constitute a legally binding agreement between you and Beema Dokaan Pvt. Ltd. ("Beema Dokaan", "we", "our", or "us"), a company incorporated under the laws of Nepal. By registering an account, you confirm that you are at least 18 years of age and have the legal capacity to enter into contracts under Nepali law.
2. Platform Description
Beema Dokaan is an insurance aggregator and distribution platform licensed by the Nepal Insurance Authority (NIA). We allow users to compare, purchase, and manage insurance policies from multiple NIA-licensed insurance companies. We also offer a promoter referral programme that allows individuals to earn commissions by referring customers to our platform.
Beema Dokaan acts as an intermediary between you and the insurance companies. The actual insurance contract is between you and the relevant insurer — not Beema Dokaan. All policies are underwritten and issued by the respective insurer, and all claims are ultimately settled by the insurer. Beema Dokaan's role is to facilitate access, comparison, purchase, and claims assistance.
3. User Accounts
To access most features of the Platform, you must create an account and complete KYC (Know Your Customer) verification. You agree to provide accurate, current, and complete information during registration and to keep your information updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
You must notify us immediately at security@beemadokaan.com.np if you suspect any unauthorised use of your account. Beema Dokaan is not liable for any loss resulting from unauthorised use of your account where we were not negligent. We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.
4. Prohibited Uses
You agree not to use the Platform to: (a) submit false or misleading information in any insurance application or claim; (b) impersonate any person or entity or misrepresent your affiliation with any person or entity; (c) attempt to gain unauthorised access to any part of the Platform or its infrastructure; (d) use automated scripts, bots, or crawlers to access the Platform without our prior written consent; (e) engage in any activity that disrupts, interferes with, or imposes an unreasonable burden on the Platform's infrastructure.
Fraudulent insurance applications or claims are a criminal offence under Nepali law and will be reported to the relevant authorities. We reserve the right to immediately terminate your account and recover any losses if we detect fraudulent activity.
5. Disclaimers
The Platform is provided on an "as is" and "as available" basis. While we strive to maintain accurate and up-to-date information, we do not warrant that the information on the Platform — including premium calculations, plan comparisons, and coverage details — is completely accurate, complete, or free of errors. You should verify all policy details with the relevant insurer before making a purchase decision.
Beema Dokaan does not guarantee continuous, uninterrupted access to the Platform. We may perform scheduled or emergency maintenance that results in temporary downtime. We will make reasonable efforts to notify users of planned maintenance in advance.
Insurance products are subject to the terms and conditions of the relevant policy document issued by the insurer. In the event of any conflict between information on the Platform and the policy document, the policy document prevails.
6. Limitation of Liability
To the maximum extent permitted by Nepali law, Beema Dokaan's total liability to you for any claims arising under or related to these Terms — whether in contract, tort, or otherwise — shall not exceed the total fees paid by you to Beema Dokaan in the 12 months preceding the event giving rise to the claim.
Beema Dokaan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages. This limitation does not apply to liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
7. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to arbitration in accordance with the Arbitration Act 2055 (1999) of Nepal. The seat of arbitration shall be Kathmandu. The language of arbitration shall be Nepali or English. The decision of the arbitral tribunal shall be final and binding on both parties.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email and by displaying a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
If you do not agree to the revised Terms, you must stop using the Platform and may close your account. Closing your account does not affect any rights or obligations that arose before the effective date of the changes, including any insurance policies already in force.
